The Clery Act also identifies certain staff, faculty and students as \u201cCampus Security Authorities\u201d and requires that they forward reports of crimes to designated offices on campus.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The Clery Act was amended in 2013 to expand the list of crimes tracked and to broaden the rights and resources that victims of sexual assault, domestic violence, sexual assault and stalking are entitled to.&nbsp; The Stop Campus Hazing Act signed into law on December 23, 2024, amends the Clery Act further to&nbsp;address broad campus safety needs.<\/p>\n\n\n\n<p>The Clery Act also requires institutions with campus police or security departments to maintain a daily crime log in an effort to provide a more \u201creal-time\u201d snapshot of crime on campus. <\/p>\n\n\n\n<p><strong>UW-Stevens Point&#8217;s&nbsp;Clery Crime Log can be found at University Police, 1925 Maria Drive (George Stien Building), Stevens Point, WI 54481.<\/strong><\/p>\n\n\n\n<p>On this website, you will find information about our Clery program, including resources for and about our Campus Security Authorities, selected Clery policies, and reporting, rights and resource information for victims of sexual assault, domestic violence, dating violence and stalking.<\/p>\n\n\n\n<p>The Clery Act was named for Jeanne Clery, a 19-year-old student who was raped and murdered in her dorm room when she was a freshman at Lehigh University in 1986.<\/p>\n\n\n\n<div class=\"uwsp-accordion blockspacetop blockspacebottom\"><div class=\"accordion\" id=\"\"><div class=\"panelcontainer nofirst\">\n<details class=\"wp-block-create-block-uwsp-accordion-section\"><summary class=\"accordion-heading\">CLERY ACT POLICY &#8211; CAMPUS SAFETY AND SECURITY REPORTING DRAFT <\/summary><div class=\"accordion-content\">\n<p>The draft Clery Act Policy is current being reviewed and has yet to move through the appropriate governance process. Once the review and approval process is complete, &#8220;draft&#8221; will be removed from this page and an &#8220;adopted&#8221; date will be added to the end of the document.<\/p>\n\n\n\n<h6 class=\"wp-block-heading\">Purpose<\/h6>\n\n\n\n<p>To establish the parameters for compliance with the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act of 1998 (commonly referrd to as the Clery Act) for all locations of the University of Wisconsin-Stevens Point.<\/p>\n\n\n\n<p><strong>Responsible Office:<\/strong>&nbsp; Chancellor and Chief Executive Officer<br><strong>Responsible Officer:<\/strong>&nbsp;Chancellor and Chief Executive Officer<\/p>\n\n\n\n<p><strong>Delegated Authority\/Process Owner:<\/strong>&nbsp;Assistant Vice Chancellor for Student Affairs and Dean of Students \/ Clery Compliance Officer<\/p>\n\n\n\n<h6 class=\"wp-block-heading\">Scope<\/h6>\n\n\n\n<p>This Policy applies to all University of Wisconsin-Stevens Point staff, faculty, and students at all UW-Stevens Point campuses, regional and satellite locations.<\/p>\n\n\n\n<h6 class=\"wp-block-heading\">Policy Summary<\/h6>\n\n\n\n<p>The Clery Act, otherwise officially known as the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act, section 485 of the Higher Education Act, codified at 20 U.S.C. 1092 (f)), is a federal law requiring colleges and universities across the United States that receive Title IV funding to disclose information about particular crimes on and around their campuses and safety related policies. It is the policy of the University to comply with its obligations under the Clery Act and Wisconsin law.<\/p>\n\n\n\n<p>The University of Wisconsin-Stevens Point is committed to providing a safe and secure learning and working environment for UW-Stevens Point students and employees consistent with the Clery Act. In accordance with statutory requirements, the University strives to ensure students, faculty, other academic staff and staff employees (the \u201cUniversity Community\u201d) have access to accurate information about crimes committed on and around the Campus; access to University wide security policies and related local campus procedures; and a confidential reporting process for victims and witnesses. This Policy describes roles and responsibilities for the University Community related to compliance with legal requirements regarding crime reporting, awareness, and prevention.<\/p>\n\n\n\n<h6 class=\"wp-block-heading\">Definitions<\/h6>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Annual Fire Safety Report (AFSR) \u2013&nbsp;<\/strong>Each Campus that maintains an on-campus student housing facility must publish and distribute annually by October 1 an Annual Fire Safety Report (AFSR). The AFSR includes the fire statistics and the fire safety policies and procedures for each On-Campus student housing facility for the three most recent calendar years. The AFSR may be filed separately or combined with the Annual Security Report (see below).<\/li>\n\n\n\n<li><strong>Annual Security Report (ASR) \u2013&nbsp;<\/strong>The Clery Act requires those postsecondary institutions participating in the Higher Education Act&#8217;s Title IV student financial assistance programs and each of their separate campuses to annually publish by October 1 a report containing the campus safety policy statements and Clery Crime statistics for the three most recent calendar years. This annual report is known as the Annual Security Report (ASR).<\/li>\n\n\n\n<li><strong>Campus&nbsp;<\/strong><strong>Advocates \u2013&nbsp;<\/strong>Employees of CAP Services who are professionally trained and certified to provide confidential support and counseling services to victims of sexual violence, sexual assault, domestic violence, dating violence, or stalking. Campus Advocates are not CSAs under this Policy. Advocates are privileged and confidential resources in accordance with Wisconsin state law.<\/li>\n\n\n\n<li><strong>Campus SaVE Act \u2013&nbsp;<\/strong>Passed in 2013, Campus SaVE Act amends the Clery Act by expanding the reporting categories for crime statistics (sexual assault, domestic violence, dating violence, and stalking) and the requirements for educational programming and notification of victims&#8217; rights.<\/li>\n\n\n\n<li><strong>Campus Security Authority (CSA) \u2013&nbsp;<\/strong>Individuals at the University who because of their functional role have an obligation to notify the University department responsible for collecting crime information (&nbsp;<em>e.g<\/em>., the campus police department) of alleged Clery Crimes that are reported to or witnessed by the CSA. CSAs include campus police employees and other persons who:\n<ol class=\"wp-block-list\">\n<li>Have responsibility for campus security but who are not employees of a campus police department or a campus security department;<\/li>\n\n\n\n<li>Are specified in the campus ASR as an individual to whom students and employees should report criminal offenses; or<\/li>\n\n\n\n<li>Have significant responsibility for student and campus activities, including, but not limited to, student housing, student discipline and campus judicial proceedings.&nbsp;<\/li>\n<\/ol>\n<\/li>\n\n\n\n<li><strong>Clery Crimes \u2013&nbsp;<\/strong>The Clery Act requires that certain crimes occurring on campus Clery Geography (as defined below) be reported annually by the Campus to the U.S. Department of Education and shared with the University Community. The following offenses are Clery Crimes: criminal homicide (murder and non-negligent manslaughter and manslaughter by negligence), sex offenses (rape, fondling, incest and statutory rape), robbery, aggravated assault, arson, burglary, motor vehicle theft, domestic violence, dating violence, stalking, Hate Crimes (as defined below), and arrests or referrals for disciplinary action for drug abuse, liquor and\/or weapons law violations.<\/li>\n\n\n\n<li><strong>Clery Geography \u2013&nbsp;<\/strong>The campus geographic areas, as defined by the Clery Act, for which Clery Crimes are required to be reported. The geographic categories include the following:\n<ol class=\"wp-block-list\">\n<li><strong>On-Campus&nbsp;<\/strong><strong>\u2013&nbsp;<\/strong>Any building or property (i) owned or controlled by the University within the same reasonably contiguous geographic area and used by the University in direct support of, or in a manner related to, the University&#8217;s educational purposes, including residence halls; (ii) that is within or reasonably contiguous to the campus that is owned by the University but controlled by another person, is frequently used by students, and supports institutional purposes (such as a food or other retail vendor).<\/li>\n\n\n\n<li><strong>Public&nbsp;<\/strong><strong>Property&nbsp;<\/strong><strong>\u2013&nbsp;<\/strong>All public properties, including thoroughfares, streets, sidewalks, and parking facilities, that are within the campus, or immediately adjacent to and accessible from the campus.<\/li>\n\n\n\n<li><strong>Non-Campus Property<\/strong>\n<ol class=\"wp-block-list\">\n<li>Buildings or property that are:\n<ol class=\"wp-block-list\">\n<li>owned or controlled by the University; and<\/li>\n\n\n\n<li>used in direct support of, or in relation to, the University&#8217;s educational purposes, and<\/li>\n\n\n\n<li>frequently used by students, and<\/li>\n\n\n\n<li>not within the same reasonably contiguous geographic area of the University campus; or<\/li>\n<\/ol>\n<\/li>\n\n\n\n<li>Any building or properties owned or controlled by a student organization that is officially recognized by the University, or<\/li>\n\n\n\n<li>Any property outside of the United States if the property otherwise meets the definition of Non-Campus Property described above in subsections a. or b.&nbsp;<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n\n\n\n<li><strong>Clery Compliance Officer \u2013&nbsp;<\/strong>The employee appointed by the Executive Officer, or designee, to coordinate the gathering of all data and policies necessary for the timely filing and distribution of the Annual Security Report and Annual Fire Safety Report.<\/li>\n\n\n\n<li><strong>Emergency Notification \u2013&nbsp;<\/strong>A notification issued by a designated Campus official promptly informing the University Community, upon confirmation, of a significant emergency or dangerous situation occurring on the campus involving an immediate threat to the health or safety of the University Community.<\/li>\n\n\n\n<li><strong>Emergency Response and Evacuation Procedure Test &#8211;&nbsp;<\/strong>Regularly scheduled drills, exercises, and appropriate follow-through activities, designed for assessment and evaluation of emergency plans and capabilities. The campuses&#8217; procedures to test the emergency response and evacuation procedures are on at least an annual basis and must include an Emergency Notification and an evacuation component for a significant portion of the campus.<\/li>\n\n\n\n<li><strong>Executive Officer \u2013&nbsp;<\/strong>Chancellor of the University of Wisconsin-Stevens Point.<\/li>\n\n\n\n<li><strong>Hate Crime \u2013&nbsp;<\/strong>A crime reported to local police agencies or to a CSA that manifests evidence that the victim was intentionally selected because of the perpetrator&#8217;s bias against the victim. For the purposes of this section, the categories of bias include the victim&#8217;s actual or perceived race, religion, gender, gender identity, sexual orientation, ethnicity, national origin, and disability. For&nbsp;<em>Clery Act&nbsp;<\/em>purposes, Hate Crimes include any of the following offenses that are motivated by bias: murder and non-negligent manslaughter, manslaughter by negligence, sex offenses (rape, fondling, incest and statutory rape), robbery, aggravated assault, burglary, motor vehicle theft, arson, larceny-theft, simple assault, intimidation, or destruction\/damage\/vandalism.<\/li>\n\n\n\n<li><strong>Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics&nbsp;<\/strong><strong>Act&nbsp;<\/strong><strong>(Clery Act) \u2013&nbsp;<\/strong>Also known as the Clery Act, this federal law requires colleges and universities that receive Title IV funding to disclose information about Clery Crimes occurring on Clery Geography and safety related policies.<\/li>\n\n\n\n<li><strong>Missing Student Notification \u2013&nbsp;<\/strong>A notification issued to an emergency contact, and\/or a parent\/legal guardian and the local law enforcement agency by a designated UWSP official when a student who lives in On-Campus housing has been missing for 24 hours.<\/li>\n\n\n\n<li><strong>Pastoral Counselors \u2013&nbsp;<\/strong>Individuals associated with and recognized by a religious order or denomination as someone who provides confidential counseling and is functioning within the scope of the recognition. Pastoral Counselors do not have CSA responsibilities.<\/li>\n\n\n\n<li><strong>Professional Counselors \u2013&nbsp;<\/strong>Individuals whose official responsibilities include providing mental health counseling to members of the University Community and who function within the scope of the counselor&#8217;s license or certification. When acting within the scope of these responsibilities, Professional Counselors are not CSAs.<\/li>\n\n\n\n<li><strong>Timely Warning \u2013&nbsp;<\/strong>A notification issued by the campus police department to alert the University Community about Clery Crimes occurring within the campus&#8217; Clery Geography:\n<ol class=\"wp-block-list\">\n<li>Reported to, or observed by a CSA; and<\/li>\n\n\n\n<li>Considered by the campus to represent a serious or continuing threat<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n\n\n\n<h6 class=\"wp-block-heading\">Policy Text<\/h6>\n\n\n\n<p>Each campus must comply with the requirements set forth in the Clery Act and Wisconsin state laws in furtherance of providing a safe and secure learning and work environment for UW-Stevens Point students and employees. System wide and local audit\/compliance offices&nbsp;will&nbsp;conduct periodic audits to confirm compliance with this Policy and any related local&nbsp;procedures.<\/p>\n\n\n\n<h6 class=\"wp-block-heading\">Compliance\/Responsibilities<\/h6>\n\n\n\n<ol class=\"wp-block-list\">\n<li>A. Requirements of the Clery Act<\/li>\n<\/ol>\n\n\n\n<p>The University will:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Publish an Annual Security Report (ASR)<\/li>\n\n\n\n<li>Identify, notify, and train Campus Security Authorities (CSAs)<\/li>\n\n\n\n<li>Disclose crime statistics including reports of domestic violence, dating violence, and stalking<\/li>\n\n\n\n<li>Issue Timely Warnings<\/li>\n\n\n\n<li>Issue Emergency Notifications<\/li>\n\n\n\n<li>Respond to reports of missing students<\/li>\n\n\n\n<li>Compile, report, and publish fire data in an Annual Fire Safety Report (ASFR)<\/li>\n\n\n\n<li>Maintain a Daily Crime Log and maintain a Daily Fire Log<\/li>\n\n\n\n<li>Notify victims of domestic violence, dating violence, stalking, and sexual assault of their rights and support resources<\/li>\n\n\n\n<li>Maintain institutional policies to address and prevent campus sexual violence<\/li>\n\n\n\n<li>Conduct primary prevention and awareness programs to prevent dating violence, domestic violence, sexual assault and stalking in accordance with the Campus SaVE Act<\/li>\n<\/ol>\n\n\n\n<p>B.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Chancellor, Provost, Vice Chancellors, Deans, Department Heads, Managers and Supervisors<\/p>\n\n\n\n<p>1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Assist in identifying CSAs in their respective areas, and ensure that these individuals receive appropriate training and notification of their Clery Act obligations.<\/p>\n\n\n\n<p>2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Ensure that, using the functional duties of a position rather than the job title, Clery Act\/CSA responsibilities are included in appropriate position descriptions.<\/p>\n\n\n\n<p>C.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Clery Compliance Officer:<\/p>\n\n\n\n<p>The Clery Coordinator\/Officer, or designee, responsibilities must include, but are not limited to, the following:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Collaborating with the campus police department and other appropriate law enforcement agencies in the collecting, and reporting crime statistics for Clery Crimes on Clery Geography as defined in the Clery Act.<\/li>\n\n\n\n<li>Publishing and distributing annual crime statistics through the ASR.<\/li>\n\n\n\n<li>Collaborating with the campus police department, reviewing the statistics for accuracy prior to submission to the U.S. Department of Education.<\/li>\n<\/ol>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Coordinating with campus planners and\/or other similar departments, developing and classifying local Clery Geography parameters.<\/li>\n\n\n\n<li>Coordinating the distribution of this Policy, and related campus procedures, with appropriate campus offices.<\/li>\n\n\n\n<li>Chairing local Clery Act compliance committee.<\/li>\n\n\n\n<li>Serving as liaison with the University of Wisconsin System regarding Clery Act matters.<\/li>\n\n\n\n<li>Coordinating with University Police and housing staff to ensure compliance\/coordination of the AFSR.<\/li>\n\n\n\n<li>Distribute the ASR and AFSR to current employees, enrolled students, prospective employees, and prospective students with a notice that includes a statement of the report&#8217;s availability, the exact electronic address at which the report is posted, a brief description of the report&#8217;s contents, and a statement that the campus will provide a paper copy of the report upon request.<\/li>\n\n\n\n<li>Identifying all Campus Security Authorities (CSAs) and notifying them of their designation and responsibilities as a CSA.<\/li>\n\n\n\n<li>Ensuring that all CSAs are trained upon their initial appointment and provided with ongoing training as appropriate.<\/li>\n\n\n\n<li>Coordinating with appropriate campus units regarding emergency management items related to the Clery Act including a statement of policy regarding disclosure of emergency response and evacuation procedures, conducting and publicizing a Clery Act compliant Emergency Response &amp; Evacuation Procedure Test RISK MGT? at least once per year, and the maintaining appropriate documentation for each test.<\/li>\n\n\n\n<li>Coordinate as appropriate with other campus units, such as the campus Title IX office, to ensure comprehensive response and prevention with respect to Clery crimes.<\/li>\n<\/ol>\n\n\n\n<p>D.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Campus Security Authority (CSA)<\/p>\n\n\n\n<p>Using the functional duties of a position, rather than the job title, UW-Stevens Point campuses must identify and inform students, faculty, other academic staff, staff employees, and volunteers (paid or unpaid, if deemed to be a CSA based on their function) of CSA reporting responsibilities and provide the CSAs with appropriate training.<\/p>\n\n\n\n<p>The CSA, other than members of the campus police department, may not investigate any crime or seek to apprehend any perpetrator. Nothing contained herein is intended to preclude a CSA from conducting appropriate investigations pursuant to other University policies. Any CSA who knowingly fails to report a crime may be subject to disciplinary action.<\/p>\n\n\n\n<p>The CSAs&#8217; responsibilities include, but are not limited to, the following:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Reporting in good faith, immediately or as soon as reasonably any Clery Act crimes or incidents which they have been made aware, or witnessed, including information regarding:\n<ol class=\"wp-block-list\">\n<li>When the crime or incident occurred,<\/li>\n\n\n\n<li>When the crime or incident was reported,<\/li>\n\n\n\n<li>Where the crime or incident occurred, and<\/li>\n\n\n\n<li>The nature or description of the crime or incident.<\/li>\n<\/ol>\n<\/li>\n\n\n\n<li>The CSA is not a confidential resource. Therefore, the CSA is encouraged to inform victims of crimes of their confidential resources, including the campus Counseling Center and the Campus Advocates, who provide confidential counseling and support for victims of sexual assault, domestic and dating violence and stalking. The Campus Advocates also provides information about available campus\/community resources and the rights and options regarding reporting the crime to the police.<\/li>\n<\/ol>\n\n\n\n<p>E.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Local Implementation Responsibilities:<\/p>\n\n\n\n<p>Each campus must:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Have procedures that allow for students and employees to voluntarily and anonymously notify the University of crimes on and around campus.<\/li>\n\n\n\n<li>Identify, notify, and train all Campus Security Authorities (CSAs).<\/li>\n\n\n\n<li>Ensure that there are local implementing procedures in place to comply with the Clery Act.<\/li>\n<\/ol>\n\n\n\n<p>F.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Title IX Coordinator<\/p>\n\n\n\n<p>1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Ensure that the university provides ongoing awareness campaigns regarding sexual assault, domestic violence, dating violence, and stalking.<\/p>\n\n\n\n<p>G.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; University Police and Security Services<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Per University Police and Security Services policy 109.00, the campus police department will maintain a public crime log, recording criminal incidents within two business days in accordance with regulatory requirements.<\/li>\n\n\n\n<li>Per University Police and Security Services policy 109.00, the campus police department will maintain a public fire log, recording incidents of fire within on-campus housing facilities within two business days in accordance with regulatory requirements.<br><br>&nbsp;<\/li>\n\n\n\n<li>The campus police department or other designated departments are responsible for providing Timely Warnings\/Emergency Notifications and Missing Student Notifications in accordance with the Clery Act.<\/li>\n\n\n\n<li>Any reports of sexual assault received by campus police must be immediately, or as soon as practicably possible, disclosed to the local law enforcement agency with whom the campus has a Memorandum of Understanding (MOU). The campus police may only disclose the identities of the victim and the alleged perpetrator to the local law enforcement agency(ies) if the victim consents to being identified.<\/li>\n\n\n\n<li>The campus police department will coordinate with the Clery Compliance Officer who is responsible for filing the ASR.<\/li>\n<\/ol>\n\n\n\n<p>H.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Risk Management \u2013 move evacuation\/alert system testing here?<\/p>\n\n\n\n<p>I.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Confidential Resources<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>All confidential offices on campus are exempt from CSA reporting requirements and include but are not limited to the Campus Advocates office, UW-Stevens Point Counseling Center, and contracted counseling services at regional campuses or satellite locations.<\/li>\n\n\n\n<li>Disclosures made to Professional Counselors, licensed psychologists, and Pastoral Counselors, are privileged and confidential and are exempt from the CSA reporting requirements.<\/li>\n\n\n\n<li>Campus Advocates in the employment of CAP Services, Inc. are confidential resources for victims seeking assistance for crimes of a sexual nature and the Campus Advocates are exempt from reporting such crimes. Disclosures about sexual violence incidents to Campus Advocates will not trigger a University investigation.<\/li>\n\n\n\n<li>Advocate services question for regional campuses?<br><\/li>\n<\/ol>\n\n\n\n<p>J.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Annual Security Report (ASR) and Annual Fire Safety Report (AFSR)<\/p>\n\n\n\n<p>By October 1 of each year, UW-Stevens Point will publish and disseminate the ASR and the AFSR that are compliant with the Clery Act. The ASR and ASFR will include data for the main campus in Stevens Point, regional campuses in Marathon County and Marshfield\/Wood Count, and satellite locations (e.g., Treehaven). The University will submit the web based crime statistics to the U.S. Department of Education by a date set annually by the Department of Education (typically mid-October).<\/p>\n\n\n\n<p>The University is required to distribute the ASR and AFSR to current employees, enrolled students, prospective employees, and prospective students with a notice that includes a statement of the reports&#8217; availability, the exact electronic address at which the report is posted, a brief description of the reports&#8217; contents, and a statement that the campus will provide a paper copy of the report upon request.<\/p>\n\n\n\n<p>ASRs, AFSRs and supporting documents will be retained for as long as designated in UWS Records Retention policy. These are also the crimes that are required to be disclosed in the Annual Security and Fire Safety Report, which is published every year on October 1. You may use the general&nbsp;<a href=\"https:\/\/cm.maxient.com\/reportingform.php?UnivofWisconsinStevensPoint\">Incident Reporting<\/a>&nbsp;form to report a crime.&nbsp;<strong>NOTE&nbsp;<\/strong>that UW-Stevens Point uses seperate online forms for reports of&nbsp;<a href=\"https:\/\/cm.maxient.com\/reportingform.php?UnivofWisconsinStevensPoint&amp;layout_id=3\">Sexual Assault<\/a>,&nbsp;<a href=\"https:\/\/cm.maxient.com\/reportingform.php?UnivofWisconsinStevensPoint&amp;layout_id=6\">Interpersonal Violence<\/a>&nbsp;(domestic violence, dating violence, stalking), and&nbsp;<a href=\"https:\/\/cm.maxient.com\/reportingform.php?UnivofWisconsinStevensPoint&amp;layout_id=2\">Bias Incidents\/Hate&nbsp;Crimes<\/a>.&nbsp;\u200b<em><strong>Primary Crimes<\/strong><\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Murder and Non-negligent Manslaughter&nbsp;<\/strong>is&nbsp;<em>the willful (non-negligent) killing of one human being by another.<\/em><em>&nbsp;<\/em><\/li>\n\n\n\n<li><strong>Manslaughter by&nbsp;Negligence&nbsp;<\/strong>is&nbsp;<em>the killing of another person through gross negligence.&nbsp;&nbsp;<\/em><em>(Does not include traffic fatalities.)<\/em><\/li>\n\n\n\n<li><strong>Rape:&nbsp;<\/strong><em>The penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim.<\/em><\/li>\n\n\n\n<li><strong><em>Fondling:&nbsp;<\/em><\/strong><em>The touching of the private body parts of another person for the purpose of sexual gratification, without the consent of the victim, including instances where the victim is incapable of giving consent because of his\/her age or because of his\/her temporary or permanent mental incapacity.<\/em><\/li>\n\n\n\n<li><strong>Incest:&nbsp;<\/strong><em>Nonforcible sexual intercourse between persons who are related to each other wherein marriage is prohibited by law.&nbsp;&nbsp; (WI prohibits sexual intercourse between parties near than 2nd&nbsp;cousins, but allows 1st&nbsp;cousin sexual intercourse if the woman is over 55 years or if one party has a letter from a physician confirming sterility.)<\/em><\/li>\n\n\n\n<li><strong>Statutory Rape:&nbsp;<\/strong><em>Non-forcible sexual intercourse with a person who is under statutory age of consent. (Age of consent for intercourse in WI is 18)<\/em><\/li>\n\n\n\n<li><strong>Robbery<\/strong>&nbsp;is&nbsp;<em>the taking or attempting to take anything of value from the care, custody, or control of a person or persons by force or threat of force or violence and\/or by putting the victim in fear.<\/em><\/li>\n\n\n\n<li><strong>Aggravated Assault<\/strong>&nbsp;is&nbsp;<em>an unlawful attack by one person upon another for the purpose of inflicting severe or aggravated bodily injury. This type of assault usually is accompanied by the use of a weapon or by means likely to produce death or great bodily harm.<\/em><\/li>\n\n\n\n<li><strong>Burglary<\/strong>&nbsp;is&nbsp;<em>the unlawful entry of a structure to commit a felony or a theft.<\/em><\/li>\n\n\n\n<li><strong>Motor Vehicle Theft&nbsp;<\/strong>is&nbsp;<em>the theft or attempted theft of a motor vehicle.<\/em><\/li>\n\n\n\n<li><strong>Arson&nbsp;<\/strong>is&nbsp;<em>any willful or malicious burning or attempt to burn, with or without intent to defraud, a dwelling house, public building, motor vehicle or aircraft, personal property of another, etc.<\/em><\/li>\n<\/ul>\n\n\n\n<p><strong>Consent:&nbsp;<\/strong><em>Under WI law, consent is words or overt actions by a person who is competent to give informed consent indicating a freely given agreement to have sexual intercourse or sexual contact. The following persons are presumed incapable of consent but the presumption may be rebutted by competent evidence:<\/em><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><em>A person suffering from mental illness or defect which impairs capacity to appraise&nbsp;personal conduct.<\/em><\/li>\n\n\n\n<li><em>A person who is unconscious or for any other reason physically unable to communicate an unwillingness to act.<\/em><\/li>\n<\/ol>\n\n\n\n<p><em><strong>Domestic Violence, Dating Violence and Stalking (Violence Against Women Act Offenses)<\/strong><\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Domestic Violence&nbsp;<\/strong>is&nbsp;<em>a felony or misdemeanor committed by a current or former spouse or intimate partner of the victim; by a person with whom the victim shares a child in common; by a person who is cohabitating or has cohabitated with the victim as a spouse or intimate partner; by a person similarly situated to a spouse of the victim under the domestic or family violence laws of the jurisdiction in which the crime of violence occurred; or by any other person against an adult or youth victim who is protected from that person\u2019s acts under the domestic or family violence laws of the jurisdiction in which the crime occurred.<\/em><\/li>\n\n\n\n<li><strong>Dating Violence<\/strong>&nbsp;is&nbsp;<em>violence committed by a person who is or has been in a social relationship of a romantic or intimate nature with the victim. The existence of such a relationship shall be determined based on the reporting party\u2019s statement with consideration of the length of the relationship, the type of relationship, and the frequency of interaction between the persons involved in the relationship.<\/em>&nbsp;(Under WI law, dating violence is a form of domestic violence.)<\/li>\n\n\n\n<li><strong>Stalking&nbsp;<\/strong>is&nbsp;<em>engaging in a course of conduct directed at a specific person that would cause a reasonable person to (1) fear for the person\u2019s safety or the safety of others; or (2) suffer substantial emotional distress.&nbsp;Course of conduct means two or more acts, including, but not limited to, acts in which the stalker directly, indirectly, or through third parties, by any action, method, device, or means follows, monitors, observes, surveils, threatens, or communicates to or about, a person, or interferes with a person\u2019s property.&nbsp;Substantial emotional distress means significant mental suffering or anguish that may, but does not necessarily, require medical or other professional treatment or counseling.&nbsp;Reasonable person means a reasonable person under similar circumstances and with similar identities to the victim.<\/em><\/li>\n<\/ul>\n\n\n\n<p><em><strong>Hazing:&nbsp;<\/strong><\/em>The term \u2018hazing\u2019, for purposes of reporting statistics on hazing incidents\u2026means any intentional, knowing, or reckless act committed by a person (whether individually or in concert with other persons) against another person or persons regardless of the willingness of such other person or persons to participate, that:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>is committed in the course of an initiation into, an affiliation with, or the maintenance of membership in, a student organization; and&nbsp;<\/li>\n\n\n\n<li>causes or creates a risk, above the reasonable risk encountered in the course of participation in the institution of higher education or the organization (such as the physical preparation necessary for participation in an athletic team), of physical or psychological injury including\u2014\n<ul class=\"wp-block-list\">\n<li>whipping, beating, striking, electronic shocking, placing of a harmful substance on someone\u2019s body, or similar activity;&nbsp;<\/li>\n\n\n\n<li>causing, coercing, or otherwise inducing sleep deprivation, exposure to the elements, confinement in a small space, extreme calisthenics, or other similar activity;&nbsp;<\/li>\n\n\n\n<li>causing, coercing, or otherwise inducing another person to consume food, liquid, alcohol, drugs, or other substances;&nbsp;<\/li>\n\n\n\n<li>causing, coercing, or otherwise inducing another person to perform sexual acts;&nbsp;<\/li>\n\n\n\n<li>any activity that places another person in reasonable fear of bodily harm through the use of threatening words or conduct;&nbsp;<\/li>\n\n\n\n<li>any activity against another person that includes a criminal violation of local, State, Tribal, or Federal law; and&nbsp;<\/li>\n\n\n\n<li>any activity that induces, causes, or requires another person to perform a duty or task that involves a criminal violation of local, State, Tribal, or Federal law.\u200b<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p><em><strong>\u200bHate Crimes:&nbsp;<\/strong><\/em>A&nbsp;<strong>hate crime&nbsp;<\/strong>is&nbsp;<em>a criminal offense committed against a person or property which is motivated, in whole or in part, by the offender\u2019s bias<\/em>.&nbsp;<strong>Bias&nbsp;<\/strong>is&nbsp;<em>a pre-formed negative opinion or attitude toward a group of persons based on their race, gender, religion, disability, gender identity, sexual orientation, ethnicity or national origin.<\/em><\/p>\n\n\n\n<p>CSAs report the following crimes&nbsp;<strong>only<\/strong>&nbsp;if they occurred as part of&nbsp;a hate crime:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Larceny-Theft&nbsp;<\/strong>is&nbsp;<em>the unlawful taking, carrying, leading, or riding away of property from the possession or constructive possession of another.<\/em>\n<ul class=\"wp-block-list\">\n<li><strong><em>Constructive possession&nbsp;<\/em><\/strong><em>is the condition in which a person does not have physical custody or possession, but is in a position to exercise dominion or control over a thing.<\/em><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Simple Assault&nbsp;<\/strong>is&nbsp;<em>an unlawful physical attack by one person upon another where neither the offender displays a weapon, nor the victim suffers obvious severe or aggravated bodily injury involving apparent broken bones, loss of teeth, possible internal injury, severe laceration, or loss of consciousness.<\/em><\/li>\n\n\n\n<li><strong>Intimidation&nbsp;<\/strong>is&nbsp;<em>to unlawfully place another person in reasonable fear of bodily harm through the use of threatening words and\/or other conduct, but without displaying a weapon or subjecting the victim to actual physical attack.<\/em><\/li>\n\n\n\n<li><strong>Destruction\/Damage\/Vandalism of Property&nbsp;<\/strong>is&nbsp;<em>to willfully or maliciously destroy, damage, deface, or otherwise injure real or personal property without the consent of the owner or the person having custody or control of it.\u200b<\/em><\/li>\n<\/ul>\n<\/div><\/details>\n\n\n\n<details class=\"wp-block-create-block-uwsp-accordion-section\"><summary class=\"accordion-heading\">CLERY GEOGRAPHY<\/summary><div class=\"accordion-content\">\n<p><strong>On-Campus property<\/strong>:&nbsp;On campus refers to property that is owned or controlled by UW-Stevens Point&nbsp;and is within the same generally connected area. This includes academic and administrative buildings, unions, and athletic and event facilities. A subset of \u201con campus\u201d is \u201con-campus residential housing.\u201d This includes UW-Stevens Point&nbsp;residence halls and suites.<\/p>\n\n\n\n<p><strong>Public property:<\/strong>&nbsp;Public property includes thoroughfares, streets, sidewalks and parking facilities that are within campus or immediately next to or accessible to campus and on-campus property. The Department of Education uses a \u201csidewalk\/street\/sidewalk\u201d rule to determine the boundary of public property.<\/p>\n\n\n\n<p><strong>Non-Campus pro<\/strong><strong>perty:<\/strong>&nbsp;This is property that is owned or controlled by UW-Stevens Point, is used in direct support of, or in relation to, UW-Stevens Point\u2019s educational mission, is frequently used by students, and is not generally connected to main campus. This includes property owned or controlled by a registered student organization. Examples of non-campus property include the Treehaven Field Station and the Central Wisconsin Environmental Station (CWES), property owned or controlled by registered student organizations such as fraternities or sororities, property rented or leased&nbsp;by UW-Stevens Point&nbsp;for an event, research stations, and property owned and controlled abroad.\u200b<\/p>\n\n\n\n<p><strong>Separate Campus:&nbsp;<\/strong>A location that the institution owns or controls; is not reasonably geographically contiguous with the main campus; has an organized program of study and; has at least one person on site acting in an administrative capacity. Per this definition, the Aquaponic Innovation Center in Montello (WI), the Central Wisconsin Environmental Station, and the Treehaven Field Station near Tomahawk (WI) are considered separate campuses under the Clery Act.<\/p>\n\n\n\n<p>As part of the&nbsp;<a href=\"https:\/\/www3.uwsp.edu\/protsv\/Documents\/ASR-ASFR.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Annual Security Report&nbsp;and Annual&nbsp;Fire Safety Report\u200b<\/a>, UW-Stevens Point includes maps of property owned or controlled by the University. Given the size and diversity of the properties owned or controlled by UW-Stevens Point, the maps should only be used as reference tools. Questions about Clery Geography should be directed to Office of the Dean of Students.<\/p>\n<\/div><\/details>\n\n\n\n<details class=\"wp-block-create-block-uwsp-accordion-section\"><summary class=\"accordion-heading\">UWSP POLICE AND SECURITY SERVICES JURISDICTION<\/summary><div class=\"accordion-content\">\n<p>University of Wisconsin Stevens Point Police and Security Services&nbsp;Police Officers have the statutory authority and responsibility to investigate violations of state criminal and traffic laws, as well as rules of the University of Wisconsin System Board of Regents. The department&#8217;s&nbsp; jurisdictional authority is limited to all property owned by or under the control of UW Stevens Point, including a portion of any public road or highway passing through and immediately adjacent to it. Police and Security Services&nbsp;is the agency of record and is responsible for the investigation of all criminal complaints originating on campus.<\/p>\n\n\n\n<p>The authority, responsibility, and required training of Police and Security Services Police Officers is the same as all other police officers in the State of Wisconsin. All Police and Security Services Police Officers are certified by the Wisconsin Department of Justice and complete continual ongoing training to maintain this certification.&nbsp;<\/p>\n<\/div><\/details>\n<\/div><\/div><\/div>\n\n\n\n<h3 class=\"wp-block-heading\">STUDENT TRIP REPORTING DIRECTIONS<\/h3>\n\n\n\n<p>As a higher education institution, the University of Wisconsin-Stevens Point must comply with the&nbsp;Jeanne Clery Campus Safety&nbsp;Act (a federal law). A letter is sent to the location&#8217;s local law enforcement agency requesting Clery Act crime statistics that were reported to have occurred during the time frame the university had control over the space. The purpose of sending this letter is to gather crime statistics that were reported directly to the local law enforcement and thus may not be known to university personnel.<\/p>\n\n\n\n<p>* Note, other university\/departmental internal crime reporting requirements may also exist on any Clery Act reportable and non-reportable student trips.<\/p>\n<\/div><\/details>\n\n\n\n<details class=\"wp-block-create-block-uwsp-accordion-section\"><summary class=\"accordion-heading\">WHAT OFF-CAMPUS ACTIVITIES QUALIFY TO BE REPORTED? <\/summary><div class=\"accordion-content\">\n<p>Not all off-campus student activities and travel needs to be reported. To be Clery reportable, the activity must meet certain requirements.<\/p>\n\n\n\n<p>First,&nbsp;the&nbsp;<strong>university must have control over the space used for the student activity and\/or travel<\/strong>. Control, as defined by the Clery Act, means that there is a written agreement (no matter how informal) directly between the university and the end provider for use of the space.&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>Some examples of a written agreement include reserving hotel rooms, leasing apartments, leasing space for athletic purposes, or an agreement for academic space. Even if the agreement is in e-mail form, and there is no charge associated with the agreement, the space&nbsp;may still qualify as Clery reportable.<\/em><\/p>\n<\/blockquote>\n\n\n\n<p>Second,&nbsp;<strong>the controlled space must be used in direct support of, or in relation to, the institution&#8217;s educational purposes and frequented by students<\/strong>.
